If a teacher is not appropriately credentialed or qualified to be educating children with unique needs it can lead to a subsequent denial of a student's access to a Free and Appropriate Public Education (FAPE).

Qualifying for Special Education: The Meaning of "Adversely Affects"

Millions of children qualify for special education services each year based upon specific disabilities. Severe language disabilities may prevent a child from speaking in class and participating in activities. Muscle weaknesses may hinder writing abilities, which affect the Student's writing assignments and homework. However, in some cases, the negative impact of your child's disability may not be as obvious.

Understanding the IEP Process

     Every parent who attends an IEP meeting is simply looking to obtain an educational placement that is appropriate for their child, and will allow their child to make substantive progress throughout the school year. However, the IEP process can also be very stressful and confusing. What all parents should be aware of in preparing for an IEP meeting, is that the burden is on the school district to provide a Free and Appropriate Public Education ("FAPE") for all children. Not only must the educational placement be appropriate, but it also must be qualify as a clear written offer of placement. (Union Sch. Dist, v Smith, (9th Cir. 1994), 15 F.3d 1519.)

Do I Have To Sign This IEP?

You just had your child's IEP, and a bunch of information was thrown out there by multiple professionals over the course of a couple of hours. The school district administrator is now asking you to sign the place in the IEP document which indicates that you consent to the IEP. What do you do? Is it ok not to sign it?

What Is "Child Find?"

"Child Find" is a concept that refers to the affirmative, ongoing obligation of states and local school districts to identify, locate, and evaluate all children with disabilities residing within the jurisdiction that either have or are suspected of having disabilities and need special education as a result of those disabilities. The Individuals With Disabilities In Education Act ("IDEA") includes a "child find" mandate that all children with special education needs be evaluated and that their needs be identified and special education services be provided where applicable.
