Does My Child Need A Special Education Evaluation?

"All schools have an affirmative duty to locate, identify and provide services to children who may have disabilities."

Does this affect my child?

Is your child 3-20 years old? The school must complete a "Child Find" process for children 3-20 years old who live in or attend school in their district.

Is your child currently without special education services and without any evaluation from the school? The school's duty is to find a child who should be referred for an evaluation.

Does your child exhibit any of these behaviors? The threshold for suspecting that a child has a disability is low, thus if your child exhibits any of these signs, he or she may be owed an evaluation by the school.

· Falling grades or below average academic performance

· Behavior and discipline problems

· Significant absences

· Concerns expressed by parents and teachers

· Signs of substance abuse

· Medical diagnosis of a recognized disability

· Psychiatric hospitalizations

· Suicide attempts

· Request for an evaluation by a parent

What must the school do?

The Individuals with Disabilities Act (IDEA) includes the Child Find mandate. Public school districts must identify, locate, and evaluate all children with disabilities, regardless of the severity of the disability and even if the child does not actually qualify for services. This duty does not rest on the parents' shoulders.

The school district must evaluate a child once it has "knowledge of facts tending to establish a suspected disability." This knowledge can arise by evidence of one of the above triggers. Or, if you have requested an evaluation in writing, the school must respond within 15 days from the request for an evaluation.

If the school has failed its duty to find your student's disability, it has violated the law and its obligations to your child.
